Attorney General Madigan: Settlement to Resolve Illegal Dumping of Hazardous Waste in DeSoto Landfill


Springfield–(ENEWSWPF)–March 4, 2013. Attorney General Lisa Madigan announced today the filing of a settlement with a Union County firm accused of illegally dumping hazardous waste materials in an area landfill.

The settlement resolves a four-count complaint filed in Union County Circuit Court against Freeman Environmental Services, Inc., (FES) of Herrin. In 2009, FES contracted with an Anna, Ill., dry cleaner to remove and properly dispose of chemicals from the business. According to Madigan’s complaint, FES failed to test and identify the hazardous waste before it was discarded at a landfill in Desoto. In addition, the complaint alleges FES used non-permitted vehicles to transport the hazardous material to the landfill.

“Waste removal companies are responsible for knowing and complying with state laws that require the safe removal and disposal of hazardous waste,” Madigan said. “This company will pay the price for violating the standards in place to protect public health and the environment.”

Under terms of the consent order, FES will pay a civil penalty of $15,000.

Assistant Attorney General Kelly Phelps is handling the case for Madigan’s Environmental Bureau.
