Federal Judge Rules Provision of Health Care Reform Law Is Unconstitutional


VIRGINIA—(ENEWSPF)—December 13, 2010.  U.S. District Court Judge Henry E. Hudson, an appointee of President George W. Bush, has just ruled that the individual mandate provision of the Obama Health Care Reform legislation is unconstitutional.

In Commonwealth of VA v. Sebelius, Virginia Attorney General Kenneth Cuccinelli argued that Congress exceeded its Constitutional authority by requiring individuals to maintain health insurance.  The individual mandate provision of the legislation does not become effective until 2014.

It is anticipated that the Department of Justice will appeal this ruling.
